3. Booking and Scheduling
To schedule a service, clients must contact Gardener Mitcham via our official channels. Appointments are subject to availability and confirmation. We strive to accommodate your preferred dates and times, but cannot guarantee specific slots.
3.1. Confirmation
Once a booking is made, you will receive a confirmation outlining the details of the service, including date, time, and estimated costs.
3.2. Rescheduling
If you need to reschedule an appointment, please notify us at least 48 hours in advance. Failure to do so may result in a cancellation fee.
4. Payment Terms
Payments for services rendered must be made in full upon completion unless otherwise agreed upon in writing. We accept various payment methods, including cash, credit/debit cards, and bank transfers.
4.1. Pricing
Our pricing is competitive and based on the scope of work required. Detailed quotes will be provided prior to commencing any service.
4.2. Late Payments
Late payments may incur additional charges. If you are experiencing difficulties with payment, please contact us to discuss alternative arrangements.
5. Cancellation Policy
Clients may cancel or reschedule services by providing at least 48 hours' notice. Cancellations made within 48 hours of the scheduled service may incur a cancellation fee equivalent to 50% of the service cost.
6. Liability
Gardener Mitcham strives to perform all services with care and professionalism. However, we are not liable for any damage caused by natural factors such as weather conditions or pests. Additionally, we are not responsible for any pre-existing conditions in the garden unless otherwise specified in the service agreement.
6.1. Insurance
We maintain comprehensive liability insurance to cover any unforeseen incidents during the provision of our services.
7. Client Responsibilities
Clients are responsible for providing access to the property at the scheduled time and ensuring that the garden area is clear of personal belongings or items that could hinder our work. Clients must also disclose any known issues or concerns related to their garden to ensure effective service delivery.
8. Intellectual Property
All designs, plans, and materials produced by Gardener Mitcham remain the intellectual property of the company. Clients are granted a limited license to use these materials for personal purposes only.
9. Termination of Services
Gardener Mitcham reserves the right to terminate services at any time if clients breach these terms and conditions. In such cases, any fees for services rendered up to the termination date will be due immediately.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Gardener Mitcham operates. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the local courts.
11. Amendments

15. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining terms will remain in full force and effect.
16. Entire Agreement
These terms and conditions constitute the entire agreement between Gardener Mitcham and the client regarding the services provided. They supersede all prior agreements, understandings, and representations.

18. No Waiver
The failure of Gardener Mitcham to enforce any right or provision of these terms does not constitute a waiver of such right or provision.

Clients may not assign or transfer their rights or obligations under these terms without prior written consent from Gardener Mitcham. Similarly, Gardener Mitcham may assign its rights and obligations as needed to continue providing services.
